Welcome to Ferava. Ferava is operated by DS SCALE LLC, a limited liability company registered in Wyoming, United States, with its registered office at 30 N Gould St, Ste R, Sheridan, WY 82801, United States.

Ferava operates the website ferava-shop.com (the "Site"), including all related information, content, features, tools, products and services made available through the Site (collectively, the "Services"). The Site is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy.

If you do not agree with these Terms, please do not use the Services.

2. Eligibility, Access and Accounts

You must be at least 18 years old to purchase products from Ferava.

When using the Services, you may be asked to provide information such as your name, email address, billing address, shipping address, payment details or other account information. You agree that the information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. You must not transfer, sell, assign or license your account to another person.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, ingredient information and other information shown on the Site are accurate and up to date. However, colours, packaging or product appearance may vary slightly depending on your device, screen settings, manufacturing updates or packaging changes.

We reserve the right to update product descriptions, formulations, packaging, prices or availability where permitted by law. We may also discontinue a product or limit quantities available to a person, household, geographic area or jurisdiction.

4. Food Supplement and Health Disclaimer

Ferava Iron+ Ferritin is a food supplement. It is not a medicine and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle. Do not exceed the recommended daily dose. Keep out of reach of children.

If you are pregnant, breastfeeding, taking medication, have a medical condition, or have a diagnosed or suspected iron disorder, consult a GP or another qualified healthcare professional before use.

Individual results vary. Testimonials, reviews and customer experiences shown on the Site reflect individual experiences and are not a guarantee of specific results. Nothing on the Site constitutes medical advice.

5. Orders

When you place an order, you are making an offer to purchase the selected products. You will receive an order confirmation email acknowledging receipt of your order.

A binding contract is formed when we accept and dispatch your order.

We reserve the right to refuse, limit or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or listing errors, payment issues, stock unavailability, misuse of promotions or other legitimate operational reasons.

If we cancel an order after payment has been taken, the relevant amount will be refunded to your original payment method.

Purchases are intended for personal or household use unless we expressly agree otherwise.

6. Prices, Billing and Payment

Prices are displayed in pounds sterling (GBP) for customers shopping through our UK-facing store and include applicable taxes where required, unless otherwise stated at checkout.

Delivery charges, where applicable, are shown before you complete payment.

We accept the payment methods shown at checkout. Payments are processed securely through Shopify and supported payment providers or digital wallets.

Prices, discounts and promotions may change without notice. Any price change will not affect an order that has already been accepted, except where required to correct an obvious pricing error and permitted by law.

You agree to provide current, complete and accurate billing, payment and account information for all purchases made through the Site.

7. Promotions, Discount Codes and Bundles

Promotional offers, discount codes, subscription discounts and bundle pricing, including multi-bottle offers, may be subject to additional terms displayed with the relevant offer.

Promotions may be time-limited, subject to stock availability, restricted to certain products or customers, and may not be combined unless expressly stated.

We reserve the right to withdraw or amend a promotion where permitted by law.

8. Shipping and Delivery

Shipping, processing times, tracking and delivery information are described in our Shipping Policy.

Delivery dates are estimates and may be affected by carrier delays, weather, peak periods or circumstances outside our reasonable control.

For UK consumers, risk in the goods passes to you when the goods are delivered to you or to a person identified by you to receive them, unless applicable law provides otherwise.

9. Returns, Refunds and Cancellations

Your cancellation and refund rights, including our 90-day money-back guarantee on your first order and your statutory consumer rights, are set out in our Refund Policy. We don't ask customers to send products back.

If you have a concern about an order or a charge, please contact support@ferava-shop.com before raising a dispute with your bank or card provider. We reply within 1 business day and will work with you to resolve it. Charges appear on your bank statement as SP FERAVA.

Nothing in these Terms limits or excludes any statutory rights that cannot lawfully be limited or excluded.

10. Subscriptions

Recurring orders and Subscribe & Save purchases are governed by our Subscription Policy.

Before you subscribe, we show you the price, delivery frequency, discount and how to cancel. We email you at least 3 days before every renewal. There is no minimum term and no cancellation fee.

11. Intellectual Property

All content on the Site, including the Ferava name, logo, product names, text, graphics, images, photographs, videos, design elements and other materials, is owned by or licensed to DS SCALE LLC and is protected by applicable intellectual property laws.

You may use the Site and its content only for personal, non-commercial purposes.

You must not reproduce, copy, distribute, modify, republish, publicly display, sell, exploit or create derivative works from Site content without our prior written permission, except where expressly permitted by law.

Shopify's name, logos and related trademarks remain the property of Shopify or its licensors. Other third-party names and trademarks remain the property of their respective owners.

12. Optional Third-Party Tools

We may provide access to tools, features or integrations supplied by third parties. We do not necessarily monitor or control those third-party tools.

Third-party tools may be provided on an "as is" and "as available" basis and may be subject to the third party's own terms and privacy policies.

Your use of optional third-party tools is at your own discretion, and you should review the applicable provider's terms before using them.

The Services may contain links to websites, platforms or services operated by third parties.

We are not responsible for examining or evaluating the content, accuracy, privacy practices, products or services of third-party websites that we do not control.

14. Relationship with Shopify

Ferava is powered by Shopify, which provides the e-commerce infrastructure used to deliver the Services.

Any purchase made through our store is made directly between you and DS SCALE LLC trading as Ferava. Shopify is not the seller of Ferava products and is not responsible for the products you purchase from us.

Your use of certain Shopify services may also be subject to Shopify's own terms and privacy notices.

15. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Site is hosted by Shopify, certain information may also be collected and processed by Shopify to provide and improve its services.

16. Reviews, Feedback and User Content

If you submit a review, comment, image, suggestion, idea, feedback or other content ("User Content"), you confirm that you have the necessary rights to provide it and that it is accurate, lawful and based on genuine experience where applicable.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and distribute User Content in connection with our products, Services and marketing, subject to applicable law.

You must not submit content that is unlawful, defamatory, misleading, abusive, obscene, infringing, fraudulent, malicious or otherwise violates another person's rights.

We may moderate, edit or remove User Content where reasonably necessary.

From time to time, information on the Site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates or availability.

Nothing in these Terms affects any warranty, guarantee or consumer protection that cannot lawfully be excluded.

To the fullest extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis. We do not guarantee that access to the Site will always be uninterrupted, secure or error-free.

General information provided through the Site is for informational purposes only. You should not rely on Site content as medical advice or as a substitute for advice from an appropriately qualified healthcare professional.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Subject to the above and to the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses arising from your use of the Services or products.

Where legally permitted, our total liability in connection with a product order will not exceed the amount you paid for that order.

We supply products primarily for personal and household use. We are not responsible for business losses where the Services are used for commercial purposes contrary to these Terms.

To the extent permitted by applicable law, you agree to indemnify and hold harmless DS SCALE LLC, Ferava, our affiliates, officers, employees, agents, contractors, licensors and service providers from third-party claims, liabilities, losses or reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights.

This section does not apply to the extent that an indemnity would be prohibited or unenforceable under applicable consumer law.

23. Events Beyond Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including carrier disruption, severe weather, natural disasters, industrial action, government action, telecommunications outages or similar events.

Where such an event occurs, we will take reasonable steps to minimise its effect on our obligations.

24. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or treated as severed where necessary.

The remaining provisions will continue in full force and effect.

25. Waiver and Entire Agreement

If we do not immediately enforce a right or provision under these Terms, that does not mean we waive that right or provision.

These Terms, together with the policies and terms incorporated by reference, constitute the agreement between you and us relating to your use of the Services and your purchases from Ferava.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations where permitted by law, including in connection with a reorganisation, sale, merger or transfer of our business.

These Terms are governed by the laws of the State of Wyoming, United States, subject to any mandatory consumer protections that apply in the country where you live.

If you are a consumer resident in the United Kingdom, you continue to benefit from mandatory protections available to you under applicable UK consumer law, and nothing in these Terms is intended to remove those protections.

Where applicable law gives you the right to bring proceedings in the courts of your home country, these Terms do not remove that right.

Headings are included for convenience only and do not affect the interpretation of these Terms.

We may update these Terms from time to time to reflect changes to the Services, our business practices or applicable law.

The version in force when you place an order will apply to that order unless the law requires otherwise.
